Mount Sinai Health System, Michigan Medicine, and the University of Kansas Health System filed federal lawsuits against CVS Health.
The complaints accuse CVS and its subsidiaries of diverting approximately $250 million in savings from the federal 340B drug pricing program.
The alleged scheme occurred between 2020 and 2025.
Plaintiffs claim CVS’s pharmacy benefit manager, Caremark, and its specialty pharmacy colluded to under-reimburse hospitals for discounted specialty drugs.
CVS allegedly retained the spread between standard insurance rates and artificially reduced reimbursement amounts.
The lawsuits state CVS pocketed funds intended to help safety-net providers serve vulnerable patient populations.
