Virginia State Senator Russet Perry called for State Corporation Commission (SCC) Chair Kelsey Bagot to recuse herself from reviewing NextEra Energy's proposed acquisition of Dominion Energy.

The proposed acquisition is valued at $67 billion.

Perry cited Bagot's previous role as a senior attorney at NextEra before her SCC appointment.

Perry stated that Bagot previously assured state legislators she would recuse herself from matters involving her former employer.

The senator urged Bagot to honor that commitment for this transaction.

The deal would create the largest regulated utility in the United States.

The transaction requires approval from the Virginia SCC and other regulators.

An SCC spokesperson stated the commission does not comment on current or potential cases.

The spokesperson noted that parties have not yet filed a formal merger application.

If Bagot recuses herself, the two remaining commissioners will decide on the deal.
