Sun Pharmaceutical Industries announced that the U.S. Court of Appeals for the Third Circuit affirmed a summary judgment in its favor. This ruling resolves an antitrust lawsuit involving the generic version of Lipitor, or atorvastatin.
The litigation originated from a 2008 patent settlement with Pfizer. Plaintiffs alleged the agreement unlawfully delayed the market entry of the generic drug.
The appellate court also upheld the denial of class certification for the plaintiffs. This decision effectively ends the decade-old litigation and removes significant legal uncertainty for the company.
